Terms of Use

These Terms of Use ("Terms") govern access to and use of the Islania Holistics platform (the "Site"), published by Virginie Thirion ("we", "the Platform"). By creating an account or using the Site, you ("the User") accept these Terms without reservation.

1. Purpose and Role of the Platform

Islania Holistics is a platform for connecting wellness and holistic therapy Practitioners with Users wishing to book sessions or purchase training courses.

The Platform acts exclusively as a technical intermediary. It is not a party to the care or service contract concluded between the Practitioner and the User, provides no healthcare service and exercises no control over the content of the sessions. See the Health Disclaimer.

2. Access and Registration

Access to certain features requires the creation of an account. The User undertakes to provide accurate, up-to-date information and to keep their login credentials confidential. Any action carried out via their account is deemed to have been carried out by them. Registration is reserved for persons of legal age or duly authorised minors (see Art. 10 of the Privacy Policy).

3. Use of the Site

The User undertakes to use the Site in a fair manner and in compliance with the law. The following are prohibited in particular:

  • identity theft, the provision of false information;
  • any impairment of the operation, security or integrity of the Site;
  • the publication of unlawful, defamatory, hateful content or content infringing the rights of third parties;
  • the unauthorised collection of other users' data;
  • any misappropriation of the Site for unintended commercial purposes.

4. Bookings, Training Courses and Payments

The terms and conditions for booking sessions are detailed in the Appointment Booking Terms, and the purchase of training courses in the Terms of Sale for training courses. Payments are processed via a secure payment provider. The Platform collects the amount on behalf of the Practitioner, deducts its commission and pays the balance to the Practitioner.

5. Reviews and User Content

The User may post reviews. These reviews must be honest, based on a genuine experience and respectful. The Platform reserves the right to remove any review contrary to these Terms or the law, without this calling into question the overall authenticity of the reviews published.

5b. Training Forums

Each training course may give access to a dedicated forum, access to which may be conditional upon registration for the training course and/or the User's progress (successful completion of certain chapters or modules). The Practitioner who authored the training course is its default moderator.

By posting on a forum, the User undertakes to comply with these Terms and, in particular, not to disseminate any unlawful, defamatory, hateful, misleading content, content contrary to public morals or infringing the rights of third parties, nor any advice presented as medical. The User remains solely responsible for the content they post and grants the Platform the right to host and display it in the context of the service.

The moderating Practitioner and the Platform may remove any content contrary to these Terms or the law. The Platform, as a host, makes available a means of reporting unlawful content and processes these reports in accordance with the applicable regulations (in particular the European Digital Services Act – DSA).

5c. Practitioner Showcase Pages

Each practitioner may have a showcase page accessible via a personalised address (firstname.islaniaholistics.com), created automatically, on which they freely publish their information, visuals, videos, documents and logo. This content is the sole responsibility of the practitioner, who warrants that they hold the necessary rights and comply with the law. The Platform acts as a host and may remove any unlawful content reported.

5d. Testimonials and Loyalty Program

Users may record testimonials (see the "Testimonial Consent" document) and take part in the Prana loyalty program and the referral program (see the "Prana Program Terms"). These features are governed by their own terms, which supplement these Terms.

6. Liability

The care or training relationship binds exclusively the User and the Practitioner. The Platform cannot be held liable for the quality, relevance, safety or results of the services provided by the Practitioners, nor for any resulting damage.

The Platform uses reasonable means to ensure the availability of the Site, without guaranteeing uninterrupted or error-free operation. Its liability cannot be engaged in the event of force majeure or the act of a third party.

These clauses do not limit the mandatory rights granted to the consumer or liability in the event of wilful misconduct, gross negligence or harm to physical integrity.

7. Intellectual Property

See the Legal Notice. The User benefits only from a personal and non-exclusive right to use the Site.

8. Suspension and Termination

In the event of a breach of these Terms, the Platform may suspend or close the account concerned, after notification where possible. The User may delete their account at any time.

9. Amendment of the Terms

The Platform may amend the Terms. Users are informed of any substantial change, which takes effect upon its communication or at the next login.

10. Applicable Law and Disputes

These Terms are governed by Belgian law. In the event of a dispute, an amicable solution will be sought as a priority (see mediation in the Legal Notice). Failing this, the competent Belgian courts will be seised, subject to the rules protecting consumers.
